Before I was a Seattle traffic lawyer I used to wonder how a legal professional could resolve traffic fines. I would think, "I had been speeding. I got caught. Just how will they going to get me out of that?" After which I became an one and figured it out. Plus, in all honesty, it's not always that difficult. But, unfortunately, it does take a law education to be effective.
The secret is having enough information to conquer the ticket, discovering errors in processes that beat the violation, or defining it as seem like you have sufficient to conquer the violation so that the prosecutor doesn't want to squander his time. And often you simply ask properly.
For example, I fixed a traffic violation today. It had been a speeding ticket and I wanted to get it lowered to a non-moving violation (essentially what this means is it doesn't affect your vehicle insurance rates). This individual received driving under the influence when they got their exceeding the speed limit violation, and also the Dui and speeding violation were handled separately. The Driving under the influence was completed, and then the district attorney was still pursuing the speeding violation.
The violation was set for hearing, I appeared, and before the hearing I chatted with the district attorney (this can be something which occurs all the time and it is where the majority of the criminal defense bargains are made) and explained to the prosecutor that my client obtained a Driving under the influence with the speeding ticket and that the Driving under the influence was already dealt with (reduced to irresponsible driving) and requested the prosecutor what we could do to have the speeding violation lowered into a traffic infringement. After thinking about it she agreed to lower it, and voila, it had been done!
Other times it requires the risk of litigation to obtain results (and perhaps it takes several wins at trial to obtain results), plus it usually depends upon the specific details of one's case. This is exactly why I said it requires a law degree to obtain great results (or a large amount of traffic violations). A lawyer has the qualifications to determine the guidelines and procedures of practice, to determine the holes within the prosecution's case, and to express those weak points in ways the district attorney understands. I'm not declaring you cannot do it without assistance , I'm simply stating it is so much more difficult.
