There is no question that bringing forth a court case of any kind is stressful for all those that are involved. Medical negligence and malpractice cases, however, are likely to be much more stressful than most, since the claimant has usually also recently suffered from an illness. Bring such a case to court is likely therefore to cause a larger amount of stress for the client, as they are likely to have to undergo further medical procedures, relive the experience and on the whole be prevented from being able to move on with their lives.
Another negative consequence for the claimant is that there is a likelihood that they will not win the case. If this does occur, they are likely to be left with debts that run into hundreds of thousands of pounds, since medical negligence lawsuits are notoriously long, drawn out and expensive. Added to the stress that the lawsuit itself may have caused, and if the claimant loses they are likely to be left in a worse position than they had been previously. A large amount of time will also have been wasted.
Obviously there are also negative consequences for the defendant, although in serious cases this harm is justified if they have failed to carry out their job correctly. If a health professional is found not guilty after a medical malpractice lawsuit, however, their reputations are still likely to be ruined. They are unlikely to be able to find a similar job anywhere else, and their confidence in their abilities will almost certainly be ruined. This on the whole will make for a less confident person, and they are likely to worry more if they do manage to find a similar job, or get their old one back.

Despite the negative aspects clinical negligence it is very important to pursue claims if it is clear that a health professional has been in the wrong. In serious cases such as these it may be vital that the person responsible is removed from their institution and stripped of their right to work in the industry, in order to avoid other incidents in the future.
